A Federal High Court sitting in Abuja Monday fixed a fresh October 13 date to hear the suit challenging President Bola Tinubu’s National Youth Service Corps identity brought by African Democratic Congress presidential candidate Atiku Abubakar.
At the hearing counsel to Atiku, Joseph Silas told the court that President Tinubu’s legal team has not responded with an affidavit to the motion to amend the suit, but Wole Olanikpekun legal counsel to Tinubu replied that an affidavit has been served on Atiku since September 25.
Presiding judge Justice Inyang Ekwo consequently fixed the new date to allow parties in the suit to regularise their processes.
Atiku is urging the Court to disqualify Mr. Tinubu and APC from the 2027 presidential election, claiming that Tinubu’s NYSC discharge certificate, he submitted to the Independent National Electoral Commission is not bearing his real identity.
The plaintiffs, who sued the president, APC and INEC as first to third defendants in the originating summons marked FHC/ABJ/CS/1888/2026, alleged that APC submitted a forged NYSC discharge certificate to INEC.
Atiku had told the court that there were some errors in the originating summons, they noticed a few errors, especially in the nomenclature of the INEC forms attached to their affidavit, which was referred to as Form CF001, instead of the now Form EC9A.
They also said they needed to specifically set out the particulars of the alleged fraud in their affidavit, including a written deposition of the first plaintiff (Atiku), and attach clearer copies of the exhibits referred to, but these were not available with the plaintiffs at the time of filing the suit.
Mr. Tinubu, in a counter affidavit filed on Thursday, opposed the application to amend the suit.
