Pregnant women wishing to enter the United States of America with the hope of giving birth there to enable their babies to become US citizens will no longer have the chance to do so.
The US President, Donald Trump Thursday signed two executive orders outlawing what his government described as “birth tourism.” This came after the US Supreme Court voted 6-3 in June to reject Mr. Trump’s attempts to override US constitution provision for citizenship at birth in the country.
The administration argued that the new orders fall outside the scope of the Supreme Court ruling, which struck down Trump’s original directive on a 6-3 vote.
“What that means is that no-one in the world is anymore allowed to obtain a visa for this fraudulent purpose,” White House deputy chief of staff Stephen Miller stated at the signing ceremony.
Beyond birth tourism, the orders also strip birthright citizenship rights from children born to foreign government employees in the United States and from children of individuals classified as “alien enemies.”
Trump, speaking at the White House, criticised the earlier Supreme Court ruling, describing it as “a very unfortunate decision.” He argued that people were exploiting the citizenship provision commercially.
“People are building businesses around it. That’s not the way it’s supposed to work. It’s a disgrace. They’re buying their way in, and we’re not going to let it happen,” he said.
The 14th Amendment to the US Constitution, ratified after the Civil War, has long been interpreted as guaranteeing citizenship to all persons born on American soil, with limited exceptions such as children of foreign diplomats or members of an occupying enemy force.
