David Mark’s faction of the African Democratic Congress appeared to have been totally frozen out as a Federal High Court sitting in Abuja forbade the Independent National Electoral Commission from recognising or participating in any congress of Party.
Presiding judge Joyce Abdulmalik in her ruling also barred David Mark and others from interfering with the functions and tenure of elected state executives.
The ruling stems from a suit filed by Norman Obinna and six others on behalf of ADC state chairpersons and executive committees, challenging the authority of the interim national leadership of David Mark.
In their summons Obinna and six others argued that the David Mark and his fellow executives lacked the constitutional authority to organise state congresses or appoint committees for that purpose.
Agreeing with the plaintiffs Justice Abdulmalik noted that she found “the issue in the originating summons meritorious”.
