US Supreme Court justices cast doubt Wednesday on President Donald Trump’s effort to restrict automatic birthright citizenship, leaving the administration’s legal position on shaky ground.
Trump made history by attending the session, the first sitting US president ever to watch Supreme Court oral arguments in person, before leaving once his legal team finished presenting its case.
“We are the only Country in the World STUPID enough to allow ‘Birthright’ Citizenship!” Trump wrote on Truth Social after the hearing.
Trump’s claim is factually incorrect, as many other nations, like Canada, grant citizenship by birth.
His top courtroom lawyer, Solicitor General John Sauer, faced sharp questioning, where Chief Justice John Roberts called some of the administration’s historical arguments “very quirky.”
Justice Amy Coney Barrett dismissed one legal interpretation outright, saying, “That’s not textual.”
Meanwhile, Justice Neil Gorsuch challenged a key argument about parental legal status, noting, “You don’t see domicile mentioned in the debates. The absence is striking.”
The executive order, signed on Trump’s first day back in office, would deny automatic citizenship to US-born children of undocumented immigrants or those on temporary visas.
A ruling is expected by the end of June, following nearly two hours of oral arguments. AA
